Terms of Sale
Version 2026.06.21. "X Factor Peptides" is a trade name (DBA) of X Factor Research LLC, a Maryland limited liability company ("XFP", "we", "us"). These terms govern the purchase transaction specifically, in addition to the Terms of Service and EULA.
1. The offer
Product listings are an invitation to treat, not a binding offer. A contract forms only when we accept your order and charge your payment method. We may decline or cancel any order before shipment for any lawful reason, with a full refund.
2. Eligibility to purchase
You warrant that you are 21+, a qualified researcher or institution, purchasing for in-vitro/non-clinical research, and shipping to a US address. The triple attestation at checkout is a condition of sale.
2A. Restricted research reagents
Certain listings — including semaglutide, tesamorelin, GLP-3R (tri-receptor incretin analog), and any bundle containing them — are restricted research reagents that correspond to FDA-approved, patented, or investigational pharmaceutical compounds. They are offered solely as research reagents and analytical reference standards. For any order containing a restricted reagent you must, as an additional condition of sale: (a) identify a bona fide research institution or business; (b) provide a research or business contact email; and (c) attest that you are acquiring the material exclusively for in-vitro research reasonably related to scientific or regulatory development (cf. 35 U.S.C. § 271(e)(1)). You further represent and warrant that you will not resell, redistribute, compound, or administer the material to any human or animal; that you understand the material is not an FDA-approved drug and may be subject to third-party patent rights; and that no patent, trademark, or other intellectual-property license is granted by this sale. We may refuse, hold, or cancel any restricted-reagent order at our sole discretion, including where verification is incomplete or the buyer profile is inconsistent with genuine research use.
3. Price and payment
Prices are in USD and exclude applicable sales tax, which is added at checkout where we have nexus. Payment is captured at order placement. ACH bank transfer, wire, and direct bank deposit to our U.S. business account are our payment methods. Net-30 is available for verified institutional accounts. We do not accept cryptocurrency.
4. Title and risk of loss
Title and risk of loss pass to you on delivery to the carrier (FCA — our fulfillment center). Claims for transit damage are handled under the Refund & Return Policy.
5. Shipping
US only, per the Shipping Policy. Estimated dates are estimates, not guarantees.
6. Taxes
You are responsible for any use tax in your jurisdiction where we do not collect sales tax. Tax-exempt institutional buyers must provide a valid resale or exemption certificate before we zero-rate an order.
7. Cancellation
You may cancel before the order ships by emailing [email protected] with the order number. Once shipped, the Refund & Return Policy governs.
8. Conformity
Material conforms to the published COA for its lot. The COA, not marketing copy, is the controlling specification. If the delivered lot does not match its published COA, you are entitled to replacement or refund.
9. Warranty disclaimer
EXCEPT FOR COA CONFORMITY IN §8, MATERIAL IS SOLD AS-IS WITHOUT WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE TO THE MAXIMUM EXTENT PERMITTED BY LAW. RESEARCH MATERIAL CARRIES NO WARRANTY OF SUITABILITY FOR ANY HUMAN, VETERINARY, CLINICAL, OR THERAPEUTIC PURPOSE BECAUSE NO SUCH USE IS AUTHORIZED.
10. Limitation of liability
Our aggregate liability for any order is capped at the amount you paid for that order. No indirect, consequential, special, or punitive damages.
11. Chargebacks
Open an RMA before disputing a charge. Filing a chargeback without first using the return process may result in account suspension and forfeiture of store credit, loyalty points, and gift-card balances.
11A. Indemnification
You agree to indemnify, defend, and hold harmless X Factor Research LLC and its officers, members, and agents from any claim, loss, liability, fine, or expense (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms or of any attestation made at checkout; (b) any use, resale, redistribution, administration, or human or veterinary application of material purchased from us; or (c) your violation of any law or third-party right, including intellectual-property rights, in connection with material you purchase. This obligation survives completion of the sale.
12. Governing law
Maryland law; arbitration in Montgomery County, Maryland; class-action waiver. Mirrors the Terms of Service.
